Difficulty of Care payments are funds paid to caregivers who provide support to individuals with disabilities, chronic illnesses, or age-related conditions while sharing the same residence.
When certain requirements are met, these payments may be excluded from taxable income under federal tax rules.

What Is IRS Notice 2014-7?
In 2014, the Internal Revenue Service issued Notice 2014-7 to clarify how certain Medicaid waiver payments should be treated for tax purposes.
The IRS determined that qualifying Medicaid Home and Community-Based Services (HCBS) payments may be treated as Difficulty of Care payments and excluded from taxable income when all eligibility requirements are met. For many live-in caregivers, this rule may result in significant tax savings each year.
The Live-In Requirement: The Most Important Rule
LIKELY QUALIFIES
✔ You permanently moved into your loved one’s home to provide care.
✔ You and the care recipient share the same primary residence.
✔ Meals, holidays, and daily life take place in the same household.
✔ You provide care through a qualifying Medicaid-funded program.
✔ You do not maintain a separate residence elsewhere.
MAY NOT QUALIFY
✖ You maintain your own separate home.
✖ You travel to the client’s home to work scheduled shifts.
✖ You only stay overnight occasionally.
✖ Care is provided on a temporary basis.
✖ Payments are for respite care or services provided outside the shared residence.
What Taxes May Be Excluded?
Federal Income Tax
Qualifying caregiver payments may be excluded from federal taxable income under IRS Notice 2014-7.
Michigan State Income Tax
Because Michigan generally begins with federal adjusted gross income, qualifying payments may also be excluded from Michigan income tax calculations.
Other Taxes
Social Security, Medicare, payroll taxes, and local taxes may still apply depending on your individual situation.
